How Long After Closing Can You Move Into Your New Home in Texas?

In Texas, you can usually move in the same day you close, as soon as the loan funds. The standard Texas resale contract hands possession to the buyer “upon closing and funding,” which means keys change hands when the lender’s money reaches the title company, not when you finish signing. On most Houston-area purchases that happens within hours of the signing. Sometimes it slips to the next business day.
That one phrase, closing and funding, trips up more buyers than anything else on closing day. We have watched buyers walk out of a title office with a stack of signed papers and no keys, a moving truck already idling in the new driveway.
Signing Is Not Funding
Closing in Texas is two events that usually land on the same day:
- Signing. You sign the loan documents and the deed paperwork at the title company.
- Funding. The lender reviews the signed package, then wires the loan money to the title company, which pays the seller.
Texas is a wet-funding state, so the money is expected to move at or very near the signing, not days later the way it can in a handful of western states. Possession is tied to step two. Until the loan funds, the house still belongs to the seller, and the keys stay with the seller’s side.
Cash buyers skip most of the wait. With no lender to review the package, funding happens as soon as the title company has the money and the signatures.
The Two Ways the Date Moves
The contract’s default is possession at closing and funding. Paragraph 10 of the TREC resale contract also allows possession under a temporary lease, and that is how the date moves in either direction:
| Situation | When the buyer moves in | What makes it official |
|---|---|---|
| Standard sale | The day the loan funds | The contract default |
| Seller stays after closing | The day the seller’s lease ends, up to 90 days later | Seller’s Temporary Residential Lease, signed before closing |
| Buyer moves in early | Before closing | Buyer’s Temporary Residential Lease, which many lenders and sellers decline |
The seller side of this has its own rules, rent and holdover penalties, covered in can you stay in your house after closing in Texas. If you are the buyer and a rent-back is on the table, read that first. It changes your move-in date and your insurance.
How We Would Schedule the Move
Book the movers for the day after closing, not the morning of. A Friday afternoon signing that does not fund until Monday leaves you with a truck and nowhere to unload it. A day of padding costs almost nothing and takes the funding question off the table.
A few more things that save buyers a headache:
- Ask the title company what time the lender usually funds and sign early in the day if you can.
- Do the final walkthrough within a day of closing, so you know the house is empty and in the condition you agreed to.
- Change the locks the day you get the keys. You have no idea how many copies are out there.
- Set up utilities in your name effective the closing date, not the day you plan to unload.
The Move Live Love TX Team™ is a husband-and-wife real estate team serving Houston and the surrounding areas, and we check the funding timing with the lender and the title company on every purchase before our buyers book a truck. Peter spent years in mortgage lending before real estate, so the gap between signing and funding is something we plan around, not something we find out about at the closing table. If this is your first purchase, the Buyer’s guide walks through the rest of the steps between contract and keys.
Frequently Asked Questions
- When do you get the keys after closing on a house in Texas?
- Usually the same day you sign, once the lender funds the loan. The standard Texas resale contract gives the buyer possession at closing and funding, so the keys change hands when the money moves, not the moment your pen leaves the paper.
- Why didn't I get keys at the closing table in Texas?
- Most often the loan has not funded yet. The lender reviews the signed documents and wires the money to the title company, and that can take a few hours or slip to the next business day, especially on a Friday afternoon signing.
- Can a seller stay in the house after closing in Texas?
- Yes, but only if both sides agreed to it in writing before closing with TREC's Seller's Temporary Residential Lease. That lease sets the move-out date, the daily rent and a holdover penalty, and without one the seller is expected out at closing and funding.
- Can a buyer move in before closing in Texas?
- Only with a written Buyer's Temporary Residential Lease that the seller agrees to, and many lenders and sellers say no because the buyer would be living in a home they do not own yet. Storing boxes in the garage early needs the same written agreement.
- What can delay possession after closing in Texas?
- A loan that funds late, a seller rent-back, or a seller who has not finished moving out. Schedule your movers for the day after closing, not the morning of it, and the first two stop mattering.
