Can a Veteran With an Other-Than-Honorable Discharge Get a VA Loan in Houston?

The Department of Veterans Affairs runs what’s called a character of service determination, and it looks at your actual record, not only the box your separation paperwork checked. Where Your Discharge Lands

Most veterans never think about this part because most discharges sail through without a second look. Honorable and General, Under Honorable Conditions, both meet the VA’s discharge requirement automatically. Nobody reviews your case, nobody asks questions, and your lender moves straight to service length and credit.

Three other outcomes work differently.

  • Other-Than-Honorable, or Bad Conduct from a special court-martial, go to a case-by-case character of service determination.
  • Dishonorable discharges, desertion, and certain general court-martial sentences are a hard legal bar. No character of service review changes that outcome.
  • An uncharacterized separation, common for a service member let go early in an enlistment, also gets reviewed individually rather than treated as automatic.

The Rule That Changed in 2024

Before mid-2024, an Other-Than-Honorable discharge blocked most VA benefits outright in nearly every case. That changed. In a VA news release dated April 28, 2024 and effective June 25, 2024, the VA created a compelling circumstances review for former service members with an OTH or certain bad conduct discharge. The review weighs things like combat-related trauma, military sexual trauma, and whether misconduct was tied to a mental health condition that went undiagnosed at the time of separation.

This doesn’t erase what happened. It means a veteran whose discharge paperwork looks bad on its face can ask the VA to look at the whole record, not only the final entry, before deciding whether a VA loan and the rest of the VA’s benefits are off the table for good.

What This Means for Your Houston Timeline

A character of service determination is not fast. The VA’s regional office has to review full military personnel records, and the veteran has to request the review themselves, not the lender and not the real estate agent.

Getting Your Certificate of Eligibility Moving

Start with your DD-214 or, if a character of service review is already underway, whatever paperwork the VA has sent so far. Request a Certificate of Eligibility through eBenefits or have your lender pull it, which usually takes minutes for a clean discharge. If yours is anything other than Honorable or General, Under Honorable Conditions, ask your VA regional office for the character of service review directly rather than waiting on an online system to sort it out on its own.
